The town of Neuilly-sur-Marne has opted to use the "permit to rent" scheme to combat substandard housing.
In Neuilly-sur-Marne, from 1 January 2022, owners or their agents wishing to rent out their property (for the first time or if there is a change of tenant) must have aa rental authorisation.
Why is this?

What is the legal framework?
Law no. 2014-366, known as the ALUR Law (Loi pour l'Accès au Logement et à un Urbanisme Rénové) of 24 March 2014, and its decree 2016-1790 of 19 December 2016 on the declaration and prior authorisation schemes for letting, strengthen the fight against substandard housing, enabling local authorities to better control the quality of housing in their areas.
Who is it for?
All owners or their agents must request prior authorisation to let the property. This scheme does not apply to homes rented by a social housing organisation, those subject to lease renewal, those covered by an agreement under article L.351-2 of the French Construction and Housing Code, and homes less than 10 years old.
Where?
The entire area of Neuilly-sur-Marne is covered by the rental permit.

Stage 1 - Submitting the application for prior authorisation to let
Here is the list of documents to be provided:
- CERFA form n°15652*01 "Application for prior authorisation to let a property
- A Technical Diagnostic File (DDT): every homeowner is already legally obliged to provide a Dossier de Diagnostic Technique. This includes:
- Energy Performance Diagnostic (DPE)
- Lead diagnosis for homes built before 1949 (Contract for Lead Exposure Risks)
- Asbestos diagnosis for collective dwellings built before 1 July 1997 (copy of a report indicating the presence or absence of asbestos)
- Electrical and gas diagnosis if the installation is more than 15 years old
- ESRIS (State of Servitudes, Risks and Soil Information)

Stage 2 - Issue of a receipt
- 1st case: your application is complete
We acknowledge receipt of your application, for which a receipt will be sent to you in the next few days.
⚠️ Please note! This receipt does not constitute authorisation to let. However, if no response is received within one month of receipt of your application, this is deemed to be tacit authorisation. - 2nd case: your application is incomplete
A letter notifying you of the missing information will be sent to you as soon as possible. From the date of receipt of this letter, you will have one month to provide us with the missing information, failing which your application will be rejected.
Stage 3 - Home inspection
Once the complete application has been received and the receipt sent to the owner, an inspection visit is organised by the inspector to carry out a general inspection of the property.
Stage 4 - Decision
On completion of the inspection visit, and on the basis of the report drawn up by the inspector, the owner or his authorised representative will be notified of the decision to grant or refuse authorisation.
⚠️ Please note! Any change of tenant requires a new application for authorisation to let. Prior authorisation to let becomes null and void if the property is not let within 2 years.
The authorisation must be attached to the lease.
However, landlords or their agents may be refused permission to let if the property is unsanitary or unsafe for tenants. If the owner still wishes to let the property, it must be brought up to standard. The decision to refuse the application for prior authorisation to let must state the reasons for the refusal and specify the nature of the work or improvements required to meet the aforementioned requirements.
Frequently asked questions
Do I have to pay for a rental permit?
The process is entirely free of charge.
How long is a rental permit valid for?
An authorisation is valid for 2 years. The authorisation lapses if the property is not let within two years of obtaining it.
What happens if the local authority fails to respond to a request for authorisation?
In the absence of notification of an express decision within a period of one month from receipt of the receipt for the authorisation application, the silence maintained by the authorities will be deemed to constitute authorisation to let.
What if I let my property despite being refused?
The decision to refuse an application for authorisation is forwarded to the Caisse d'allocations familiales and the tax authorities. The owner is liable to a fine. The proceeds of these fines will be paid to the Agence Nationale de l'Habitat (ANAH), whose remit is to improve existing private housing stock.
